Die regering se planne om 896 plase van ongeveer 700 000 ha ongebruikte landbougrond aan nuwe boere beskikbaar te stel, is volgens die minister van landbou, grondhervorming en landelike ontwikkeling, Thoko Didiza, deels ’n poging om die herverdeling van grond vreedsaam aan te pak en om grondeienaarskap deur ’n doeltreffende grondhervormingsprogram te volg.
Volgens die plan sal 43 000 ha in die Oos-Kaap, 8 333 ha in die Vrystaat, 3684 ha in KwaZulu-Natal, 121 567 ha in Limpopo, 40 206 ha in Mpumalanga, 12 224 ha in die Noord-Kaap en 300 000 ha in Noordwes beskikbaar gestel word. Aansoeke vir die grond moet tussen 15 Oktober en 15 November 2020 ingedien word en aansoekers moet aan die voorgeskrewe vereistes voldoen. Aansoeke sal deur ʼn komitee oorweeg word wat dan aanbevelings sal maak aan ʼn provinsiale taktiese komitee vir oorweging. Die komitee sal op hul beurt aan ʼn nasionale oorwegings- en goedkeuringskomitee voorleggings maak. Die proses behoort ongeveer agt weke te duur.
Talle voorwaardes is aan die toekenning van die grond verbonde, insluitend dat die grond vir 30 jaar gehuur kan word, dat huurders vorige boerdery-ervaring moet hê, dat die grond nie onderverhuur mag word nie en dat voorkeur aan vroue, jeugdiges en gestremdes gegee sal word.
Annelize Crosby, hoof van grondsake by AgriSA, glo dit is ʼn werkbare opsie, maar slegs indien dit reg geïmplementeer word.
“Begunstigdes moet gekeur word en opleiding ontvang, daar moet privaatsektor-vennootskappe met die staat aangegaan word en teen korrupsie gewaak word. AgriSA sou graag wou sien dat georganiseerde landbou en ander privaatsektor-rolspelers deel van die keuringsproses moet wees.
“Vroue en jongmense kan suksesvol boer, mits hulle die nodige opleiding en ondersteuning kry. Gestremde persone sal bepaalde uitdagings ondervind, maar kan sekerlik met die nodige hulp ook boer. Die klem moet egter wees op boerderyvaardighede en ʼn liefde vir boerdery.”
Nkanyiso Gumede, ʼn navorser van PLAAS, ʼn onafhanklike beleidsnavorsingsinstituut by die Universiteit van die Wes-Kaap, sê dit is onbekend hoeveel van hierdie grond reeds beset is, wat beteken dat die proses nie noodwendig toegang tot grond sal uitbrei nie, maar wel ’n proses verskaf om besetting te reguleer.
Prof Elmien du Plessis, medeprofessor aan die Noordwes Universiteit, is ook bekommerd oor die toekenning van die grond.
“Van die grond wat vrygestel word, is reeds beset deur ander mense wat dalk ook geldige eise het ten opsigte van die grond, soos aanspraak ingevolge die inheemse reg, of weens huurooreenkomste met die staat. Elke toekenning van grond sal dus noukeurig dopgehou moet word,” sê sy.
Gumede sê verder die aankondiging maak ook nie melding van die gehalte van die grond wat verskaf gaan word nie en of die begroting wat beskikbaar is om dié boere by te staan, voldoende is nie. Hierdie proses sal egter sommige boere se toegang tot grond bevoordeel.
“Die landbousektor is tans nie divers genoeg nie en hierdie proses is belangrik om te verseker dat nuwe rolspelers by die sektor ingelyf kan word om diversiteit en inklusiwiteit van die landbou-ekonomie van die land te versterk,” sê hy.
Du Plessis glo die proses is werkbaar. “Die beginsel is goed en reg en dit kan ʼn wonderlike bydrae maak tot grondhervorming, maar die duiwel is in the details, en ek het nog nie die details gesien nie.”
“Ek dink in Suid-Afrika het ons ʼn baie beperkte idee van wat ʼn ‘boer’ is, en ons fokus is baie keer net op groot kommersiële boere as ‘boere’. Boere kom voor in alle vorme en groottes, die vraag is eerder hoe kan mens die verskeidenheid boere ondersteun om suksesvol te boer. Dit lyk of daar eers opleiding sal wees voordat grond aan mense gegee sal word.”

Oor die grondwetlikheid van hierdie voorstelle sê Gumede die proses is in pas met bepalings in die grondwet.
“Art 25(5) van die grondwet verplig die staat om regstappe te doen om gelyke toegang tot grond onder landsburgers te verseker. Die proses is daarop ingestel om hierdie verpligting na te kom, maar dit is nie genoeg nie. Baie meer moet gedoen word om te verseker dat daar inklusiewe deelname aan die landbou-ekonomie kan wees en gelyke toegang tot grond vir almal in die land verseker word.”
Du Plessis is dit eens dat die staat ingevolge die grondwet verplig is om seker te maak dat daar billike toegang tot hulpbronne is en dit sluit grond in.
Gumede sê voorts dat die regering se kapasiteit om opleiding aan die nuwe boere te verskaf, beperk is, maar dat minder hulpbronne beskikbaar is omdat die grondhervormingsbegroting deur die jare verklein het.
“Die deelname van die privaatsektor in die ondersteuning van grondhervorming kan baie help om hierdie doelwitte te bereik, maar terselfdertyd moet die rol van die privaatsektor deeglik gemonitor word omdat dit dikwels nie positiewe resultate vir begunstigdes van grondhervorming gelewer het nie. Die regering moet ook hou by sy ondernemings om die privaatsektor te betrek omdat die regering soms nalaat om sy ondersteuning en oorsig uit te voer.”
Willem de Chavonnes Vrugt, voorsitter van AgriSA se grondsentrum van uitnemendheid, het in ʼn verklaring gewaarsku dat daar gewaak sal moet word teen korrupsie. Hy sê die keuring van begunstigdes om te verseker dat die grond produktief vir landbou-doeleindes aangewend word, is baie belangrik.
“Dit is jammer dat distriksgrondhervormingskomitees waarop georganiseerde landbou ook sitting gehad het, nie meer in plek is nie. Die privaatsektor en georganiseerde landbou kan ʼn baie waardevolle rol speel in die seleksie van begunstigdes en hul ondersteuning. Ons sal graag wil sien dat die distriksgrondkomitees sodanige kundigheid aan boord neem”, het De Chavonnes Vrugt bygevoeg.
Gumede deel die kommer oor die keuringsproses en is bekommerd oor wie op die distrikskomitees gaan dien wat die aanvanklike sifting gaan doen.
“Die kommer is dat die proses nie die samestelling van die siftingskomitees insluit nie en hoe dit van die bestaande streeksgrondhervormingskomitees gaan verskil nie. Hierdie komitees is gekenmerk deur probleme soos nepotisme, korrupsie en ʼn tekort aan hulpbronne om hul pligte uit te voer. Die proses kan ook diegene uitsluit wat nie na distriks- of munisipale kantore kan reis om die nodige dokumentasie te bekom of om aanlyn aansoek te kan doen nie. Die departement moet hierdie boere help sodat hulle ook voordeel uit die grondhervormingsproses kan trek.”
